Based on the laws and regulations of "Contract Law" and other relevant ones, and with the aim of equality, voluntariness, fairness and good faith,both sides of parties have reached following agreement regarding the Pizza Hut Delivery single-purpose prepaid card purchasing:
I. Basic Information of Prepaid card
1. Prepaid Card Name: Pizza Hut Delivery Cash Voucher or other kinds of Prepaid Card( hereinafter referred to as " prepaid " ) .
2. Prepaid cards are bearer cards.
3. Prepaid card validity: three years from prepaid card recoreded.
4. Prepaid card use range: card holders can use prepaid card to change products that price has not exceeded the face value of the card in China ( Hong Kong, Taiwan and Macao regionsis not included ) Actual product price is subject to the ones that it selled in store. Use Range please refer to the newest information that published on offical website.
5. Prepaid card can be shared with other speical offers, except special marked activities.
II. Purchasing of Prepaid Card
1. Every one-time prepaid card purchase above 10,000 yuan(10,000yuan is included)needs real-name registration, the First Party shall provide their valid identification card of himself/agent. Second Party should retain name or company name of buyers or agents, valid identification card number and contact information.
2. Prepaid cards purchasing , the First Party must complete an application form and provide himself or his agents' original effective-identity card and a copy of it. Card can be identification card, residence booklet, Military ID , police identification , Hong Kong, Macao and Taiwan residents passport, global passport and so on. Applicant should sign the application form to commit the responsible for authenticity of the content and will comply with the regulations of purchasing agreement.
3. For companies which buy prepaid cards, should produce valid documents and copies , including business license, certificate of legal institutions , tax registration certificate, organization code certificate and handling personnel authorized legal representative and a valid identification of the one who buys cards . Company or the one make signature on the application form to commit the responsible for authenticity of the content and will comply with the regulations of purchasing agreement.
4. For companies who buys above 5,000 yuan ( inclusive) or personal one buys 50,000 yuan above ( including ) and do not use the on-site purchase. Should purcahsed through bank transfer , Second Party retained on the turn out&turn in of account name , account number, amount and other information.
5. Second Party unified invoice when purchasing prepaid card , when using prepaid card to change products, invoices will not be given again.
III. Help Center
1. For those cards meets the following prescribed conditions , the Frist Party may apply for prepaid card extension :
( 1 ) Described use date of prepaid cards expire;
( 2 ) Prepaid card is not totally used within above period;
( 3 ) Prepaid card is integrity, not altered, torn .
2. To renew the card,Frist Party should pay renew-fee for the one-year extension . No service charge for paper cards, electronic ones are subject to the regulations when issued.
3. Purchase within 30 days from the date of buying prepaid cards , First party may ask for refund , but has to meet following conditions :
( 1 ) Provide the original card purchase certificate ;
( 2 ) The prepaid card has not been used , and is not altered, torn ;
( 3 ) Valid identity document should be provided and retained the following inforamtion:card 's name, valid ID card number, the total amount ;
( 4 ) For those who using a credit card ,should provide the used credit ;
( 5 ) Shall pay return fees to issuing corporate / vending companies, electronic ones are subject to the regulations when cards are buying ;
( 6 ) Paper vouchers cannot be returned, please refer to Article 15 for extension .
4. Second will return to the bank account that named by returner, and keep bank account information. Less than 100 Yuan(100 Yuan is included) can be paid in cash.
IV. Responsibilities and obligations
1. Second party shall describe in detail for card category , amount and terms of use when selling it to First Party.
2. Second Party shall ensure that the using process is safe, convenient and smooth.
3. Due to force majeure or electricity, telecommunications , system failures and other reasons that causes First Party cannot normally use prepaid cards, First Party should provide the necessary assistance , but do not bear for any loss caused by this.
4. Anonymous prepaid cards, first card should keep it carefully, Second Party B does offer reporting-loss service and replacement service.
5. Both parties has the obligation of confidentiality shall not disclose any content of this agreement to any third party and the confidential information learned because of commitment of this agreement.
6. First Party should only use prepaid cards under the conditions of this Agreement. It does not mean that Frist Party has obtained permission to use the trademark or other intellectual property rights of Second Party , orr any form of prepaid cards for re-sale .
7. For using violation of "Pizza Hut Delivery prepaid charter " and the agreement, Second Party is entitled to suspend the use of prepaid cards .
V. Article breach and dispute resolution
1. Termination of unexpired card use due to Second Party's reason , Second Party should offer free free card return service and announced at least 30 days prior to the designated media publicity.
2. If both parties has disputes to this Agreement disputes, they can be negotiated in advance . jurisdiction caused by Unsuccessful negotiations should charged by the courts that is in First Party's Location.
VI. Supplementary Article
1. If what wrote back of prepaid cards is inconsistent with this contract, please refer to the terms of Agreement. For what have not written, please refer to Pizza Hut Delivery Charter.
2. The Agreement is in duplicate ,both sides have one original document and bcome effective once both sides signed or stamped.
